1. Secondment within the EU

The rules on secondment within the EU are complicated, and the various inspection services have been known to show a slight suspicion about the secondment of employees within the EU.

Mint Advocaten can arm you against any potential issues by providing you with binding agreements and sound advice.

Some things that you should keep in mind:

  • the current employment legislation in Belgium (wages, overtime, bonuses, night-time work, etc.)
  • Belgian laws on posting employees
  • applying to be recognised as an employment agency, etc.
  •  applying for the necessary documents (A1, Limosa, etc.)
  •  reviewing your tax situation

If you would like to know more about secondment, download our checklist below.

If your business operations traverse borders, it is important to have a specific contract that is immediately applicable even if you carry out activities elsewhere.

  • purchase-sale contracts

4. Cross-border construction work and deploying employees

If you want to work as a contractor in Belgium, you also have to bear in mind several specific things when working with construction, such as the RS declaration, check-in at work, safety regulations, etc.
